2013/5/4凌晨2:00，剛剛經歷了一個刑案現場。

一個很乖、很惹人愛的底敵，穿了憲兵制服迎接一個自稱是「主人」的人到家裡玩。可愛底敵被操過體訓、綁成木乃伊之後，主在未經本人同意的情況下，使用底敵的臉書在塗鴉牆上留言，現場文字SNG報導他被玩的過程，底敵所有朋友都看的見。並且，事先講好只玩體訓跟木乃伊，但那個「主人」見到現場底敵家有肛塞，就臨時起意要玩肛，底敵反抗說不行，他才不玩。

當我看到底敵的帳號有不尋常、看起來不像是本人的發文後，就跟「那個人」用底敵的帳號傳訊息。他本來很驕傲地說，「牠（底敵）正被我玩弄著」，穿著甲服，「等她遊戲結束 再由她跟你說」。我問「那個人」，你有經過底敵的同意使用他的臉書嗎？他看過，沒回我。我問他，底敵今天的膠圈打的好嗎？他也看了，沒回我。（因為我知道底敵之前只有軍便服，沒有甲服。看來那個「主」連憲兵制服的樣式都搞不清楚。）最後我善意提醒他：如果未經物品主人同意就使用他的帳號po文，可能會觸犯妨害秘密罪，請小心。

後來隔了6分鐘，底敵就自己回我訊息，說那個「主人」說要看展覽沒時間了，就走了。

以上這個故事，可能牽涉到「隱私權」、刑法「入侵電腦或其相關設備罪」跟電信法的「侵犯秘密」。

司法院大法官於釋字第585號解釋，隱私權受憲法第22條保障，「基於人性尊嚴與個人主體性之維護及人格發展之完整，隱私權乃為不可或缺之基本權利。」

隱私權的保護範圍，依釋字第603號解釋，可分為「空間隱私」與「私密隱私」兩部分。所謂空間隱私，指「保障個人生活私密領域免於他人侵擾及個人資料之自主控制」，所謂私密隱私，指「保障人民決定是否揭露其個人資料、及在何種範圍內、於何時、以何種方式、向何人揭露之決定權，並保障人民對其個人資料之使用有知悉與控制權及資料記載錯誤之更正權。」

以上這個案例中的「主人」，在沒有經過底敵的同意下就使用他的臉書帳號，可能就侵犯了他「個人資料的自主控制權」，違反了「空間隱私」的保護。如果還進一步拍了底敵的木乃伊照片、裸露照po上網，則違反了「私密隱私」，也就是違反了底敵的圖片應該何時、用何種方式、向誰揭露的決定權。如果真的po上網，那也就可能構成網路罷凌了。

另外，刑法第358條（入侵電腦或其相關設備罪）也說，「無故輸入他人帳號密碼、破解使用電腦之保護措施或利用電腦系統之漏洞，而入侵他人之電腦或其相關設備者，處三年以下有期刑、拘役或科或併科十萬元以下罰金。」就好比網路釣魚程式，或是這個故事中的主人，「未經原始申請人同意，且無合法之理由而輸入帳號密碼」，即構成了無故輸入他人帳號密碼侵入他人之電腦的要件。

此外，電信法第六條規定：「電信事業及專用電信處理之通信，他人不得盜接、盜錄或以其他非法之方法侵犯其秘密。」犯了此法，「處五年以下有期徒刑，得併科新台幣一百五十萬元以下罰金。」就算是意圖要侵犯別人的祕密，即使沒有達成（未遂犯）也會被罰。在這故事中，底敵有權提起告訴，這個罪才會成立（告訴乃論）。

整體來看，這位底敵是因為家中電腦的密碼設「記憶」，因此那個「主人」可以輕易開啟電腦就使用他的臉書發文。如果底敵連網路購物商城的帳號密碼都設記憶，那麼「主人」便可能登入他的其他帳號，盜買財物寄回家裡，牽涉到的刑責就不只上述這些了。

憲兵軍犬主人要提醒所有同好，「要玩得爽、也要玩得安全，才能玩得長久」。學習一點法律常識，用來教導（或警告）那些可能侵犯你權益的人。同時，把自己的電腦、手機設備設密碼保護，都是玩得安全、長久又愉快的小撇步。

最後，我這篇文章，從頭到尾都把「主人」加引號，是因為我認為他的行為讓他表現地不像是真正負責任的主人。

這個「主人」違反了玩BDSM基本的「安全、神智清楚、知情同意」(safety, sanity, consensus) 三原則中的第一、第三原則，讓奴的身體與隱私受到侵犯，並且未在事前充分溝通，獲得彼此同意。這些在國外的BDSM圈都是被視為理所當然的原則，在台灣還沒有形成共識。至少在我接觸的美國社群，如果有人敢像故事中的主人這樣做，他的名字可能會在Recon等網站/app，或Kinky組織裡立刻黑掉，傳遍整個社群。這樣一來，他再要找奴就很難了。

當然，台灣不一定要照抄歐美的BDSM文化。那麼台灣的玩家們也可以討論，無論你是玩木乃伊、體訓軍操、角色扮演、綑綁調教、戀物（皮革、制服、緊身衣、運動服等）、打屁股、父子、痛虐，無論是哪一種路線，屬於我們台灣自己的BDSM共通規則是什麼？什麼是讓大家都能接受，並且能「玩的爽快、安全又長久」的基本原則呢？

上面這些知識除了奴、犬朋友需要學習之外，所有奇貨可居的主人們，在受到眾奴的青睞、仰望的同時，應該一起肩負起建立社群規矩的責任。

喔，別忘了，奴彼此口耳相傳的口碑（俗稱八卦），其實也是監督主的機制之一唷。呵呵～
